In a press release, USDA reiterated that it intends to conduct a “top-to-bottom review” of the Product of USA label, emphasizing concerns that the label could be confusing to consumers. The update from USDA followed an announcement by the Federal Trade Commission that it has finalized a new rule designed to crack down on misleading “Made in the USA” claims. This rule is to be published soon in the Federal Register.
As we reported last month, the National Cattlemen’s Beef Association (NCBA) recently petitioned FSIS to eliminate the use of “Product of the USA” labeling claim for beef products and initiate a rulemaking to provide for generic approval of the labeling claim “Processed in the USA” if the label complies with all other mandatory labeling requirements and is not false or misleading. FSIS is accepting comments on this petition through Aug. 17.
